Is Weed legal in New York?
No. The sale, purchase, cultivation or use of cannabis remains illegal in New York. Marijuana is decriminalized in New York, but remains federally illegal and can therefore result in fines and prison time. Simple public possession is labelled as a misdemeanor and can carry a 90-day sentence, while sales of less than 25 grams carry a $1,000 fine and a sentence of one year.
Do people still get arrested for weed in NYC?
Yes. New Yorkers still face shackles and prison time because of cannabis. While low-level possession is not viewed as a priority for the NYPD, people still get busted, particularly young people of color. Outrageously, over a 15-year period, 88% of all arrests for marijuana possession in New York City were of black and Latino people (even though young white people use marijuana at a higher rate, they made up only12% of arrests). Between 2002 and 2012, a report estimates that the NYPD spent 1 million hours making over 440,000 possession arrests. In 2012 alone, the NYPD made 39,218 low-level possession arrests which equated to 98,045 hours spent. New York has also faced staunch criticism for the racist nature of its arrests - a 2013 report discovered that African Americans in Brooklyn were 9 times likelier to be arrested for marijuana possession than whites. Brooklyn decriminalized possession in 2013 in a direct effort to curb this blatantly bigoted practice.
How do I assert my rights if I'm stopped by the police?
Here's some great advice from our friends at the New York ACLU: "You should ask if you are under arrest or free to leave ... you are not required to carry ID, and you don't have to show ID to a police officer. If you are issued a summons or arrested, however, and you refuse to produce ID or tell officers who you are, the police may detain you until you can be positively identified. Don't bad-mouth a police officer or run away, even if you believe what is happening is unreasonable. That could lead to your arrest."
Does polling show that New Yorkers support legalization?
Yes. A heavy majority of New York voters back cannabis reform. According to a recent 2014 poll, 89% of New Yorkers support legalizing medical marijuana while 57% support legalizing recreational marijuana.
What is the average cost of weed in New York City?
For the average New York consumer, $20 a gram remains a standard price. Delivery services are known to charge $50-$60 for 2.5 grams of cannabis. On a larger scale, estimates vary, but the price of pot (from low to high quality) can range from $100-$400 per ounce in New York.
How do I become a legal medical marijuana patient once it becomes legal?
To get a state ID card that allows you to use marijuana without fear of arrest, a medical practitioner will need to certify a serious medical condition that marijuana is likely to provide therapeutic or palliative benefits for. It is still unclear how long it will take for state regulators to finalize guidelines for the medical marijuana program, but check back here for updates.
Which medical conditions can I get a legal medical marijuana recommendation for?
In the proposed legislation, a serious medical condition is defined as a severe, debilitating or life-threatening condition including, but not limited to, cancer, glaucoma, positive status for HIV or AIDS, Parkinson's disease, multiple sclerosis, damage to the nervous tissue of the spinal cord with indication of intractable spasticity, epilepsy, cachexia, wasting syndrome, Crohn's disease, post-traumatic stress disorder, neuropathy, arthritis, lupus and diabetes.
Once I'm legal, where can I get my medical marijuana from?
The legislation would allow the state to license organizations to sell, deliver or distribute medical marijuana to certified patients. How much medical marijuana am I allowed to have?
Certified patients will be allowed to possess up to 2.5 ounces of marijuana.
Where am I allowed to use medical marijuana?
The proposed legislation prohibits the use of marijuana in public places, similar to guidelines for the use of tobacco. You can use it on private property (where the owner agrees to let you). Also, healthcare facilities will be allowed to designate areas for medical use of marijuana.
How much will medical marijuana cost?
A lot will depend on the market, but the legislation establishes an excise tax of 10 percent on the retail price of marijuana sold.
